The 4th Am precedent, too, doesn't seem enough. In a prior case, the Supreme Court had indicated that all those w/ sufficient connections to the US were part of "the people." Judge Thapar thinks that didn't align with historical understandings & was just a throwaway line lower courts can ignore.
