My rule of thumb is that whether the govt fights you on attorneys' fees boils down to 4 factors: 1) the amount of the fees; 2) how awful the DOJ's case was; 3) the last time the DOJ lawyer got laid; 4) the last time the agency counsel got laid. Each factor's weight changes multiple times a day.
