I'm no lawyer or anything, but I'm fairly sure my civics lessons included the fact that "Commander in Chief" doesn't give POTUS the authority to ignore the Constitution. And an Executive Order isn't a Constitutional amendment. He could sign it in gold, instead of crayon, and it still won't count.
